Reviews and appeals
If a worker or employer doesn’t agree with a decision made by WorkCover regarding a statutory claim, insurance policy, or other matter, they can apply for a review through Q-COMP, the Workers’ Compensation Regulatory Authority. People wanting to have a WorkCover decision reviewed by Q-COMP need to complete and return a Q-COMP Application for Review form within three months of receiving written notice about the decision.
If a worker or employer is aggrieved with Q-COMP’s review decision, they can appeal to the Industrial Magistrate. If either party does not agree with the Industrial Magistrate’s decision, they have the right to appeal the decision in the Industrial Court.
QWCDec is a searchable online database of Queensland workers’ compensation statutory appeals decisions. It contains all Queensland Industrial Magistrate and Queensland Industrial Relations Commission workers’ compensation decisions since 1 July 1999.
