Commencing a claim for damages

Before starting a proceeding in a court for damages (see section 302 of the WorkCover Queensland Act 1996) an injured worker must comply with:

Chapter 5 Part 2 (Entitlement Conditions) - refer sections 253 to 274
Chapter 5 Part 5 (Pre-Court Procedure) - refer sections 279 to 291
Chapter 5 Part 6 (Settlement of Claims) - refer sections 292 to 300
Section 303

Please note: the WorkCover Queensland Act 1996 makes provision for an alteration of the limitation period allowed for bringing a proceeding for damages for personal injury under the Limitation of Actions Act 1974 if the injured worker satisfies one of the paragraphs of section 308(1) and section 308(2).
