Legal costs


If the injured worker has a non-certificate injury, they cannot recover costs for any steps taken prior to the issue of the proceedings. See Part 11 (refer sections 320 - 327 of the WorkCover Queensland Act 1996) generally in relation to costs.

If the plaintiff has a certificate injury (WorkCover Queensland Act 1996), they may recover an amount for their costs. The applicable amounts are set out in Part 7 of the WorkCover Queensland Regulation 1997.
