Commencing a claim for damages


Once an injured worker has either received an offer of lump sum compensation, a damages certificate or a conditional damages certificate, they may commence their common law claim. Proceedings must be in accordance with the relevant workers' compensation legislation and the Uniform Civil Procedure Rules (UCPR).
