Workplace health and safety legislation

As you may know, from 1 January 2012 a harmonised Workplace Health and Safety system will be introduced throughout Australia. While each state will still have its own legislation and slight variations will remain from state to state, all states will operate in line with the new model Work Health and Safety (WHS) Act.
Under the new laws, the definition of a worker is broader than it was previously defined, and as a result the new WHS Act will apply not only to employees, but also to contractors and their employees, subcontractors, labour hire workers, apprentices and volunteers.
It is important for employers to be aware of how the changes may affect their business, and to review their WHS systems to align with the new Act.
