Common law only claims
A worker may elect not to claim for statutory benefits and proceed directly to common law. These applications are subject to the same injury investigation, determination and review process as statutory claim applications.
As with all claims, our focus is on rehabilitation and return to work and this type of claim will be reviewed for possible opportunities for this type of intervention.
Once the claim has been determined, the claim is managed according to the common law claims management framework.
