Who your policy needs to cover

In Queensland, if you employ workers, you must cover them for work-related injury or illness with an Accident Insurance Policy. Making sure you insure the right people helps you protect your workers and your business.

Who you need to cover

Your accident insurance policy must cover anyone who meets the definition of a ‘worker’ under workers compensation laws.

This usually includes:

  • all PAYG employees
  • some contractors.

However, there are some exceptions.

To make sure you’re covering the right people, you need to know exactly who counts as a worker.

Who is a worker?

A worker is:  

  • An individual (not a corporation, partnership or trust – although a sole trader may still be a worker).
  • An employee for PAYG withholding.
  • A person working under a ‘contract of service’, such as a subcontractor doing similar work to an employee.

What is a contract of service?

A ‘contract of service’ describes the standard arrangement between an employer and an employee.  

This is different from a ‘contract for services’, which usually applies to independent contractors.
