Worker determination tests
There are four tests that can help you work out if someone is a worker under the Workers’ Compensation and Rehabilitation Act 2003 (the Act). These are:
- Whether there is a contract for the performance of work.
- Whether the person is specifically excluded under the Act.
- Whether the person is specifically included under the Act.
- Whether the person’s working arrangement is a ‘contract of service’.
You must apply these tests in order.
